1. USER CONSENT AND DISCLAIMERS

1. Consent

   By creating a BNP AI User account and agreeing to our Terms & Conditions of Use, you consent to the collection, use, and disclosure of your Personal Data and Non-personal Data in accordance with this Data Privacy Policy.

2. Data Types
   • Personal Data - Information that identifies you (e.g., name, email, phone, billing details).
   • Non-Personal Data - Information not directly identifying you (e.g., project details, metadata, analytics).
3. Minimum Age Requirement
   • BNP AI is not accessible to users under 13 years
   • In the EU, the minimum age is 16 years.

2. DATA PERMISSION & STORAGE

• By submitting content, you confirm that you own the rights to share it.
• You are solely responsible for any third-party data used without authorization.
• BNP AI is not obligated to back up your content - you must create your own backups.
• Final deliverables remain available for a limited period after project closure.

4. PERSONAL DATA HANDLING

1. Collection

   We may collect:

   • Account Data: Name, email, phone, billing details.
   • Usage Data: Browser info, IP address, device type, cookies, timestamps.
   • Project Data: Rendering requests, AI model outputs, usage analytics.
2. Use

   Personal Data may be used for:

   • Account creation and secure login.
   • Payments, refunds, and settlements (via third-party providers).
   • Fraud detection and compliance.
   • Customer support and updates.
   • Marketing (with opt-out option).
   • Platform research and improvements.
3. Disclosure

5. NON-PERSONAL DATA HANDLING

• Used internally for analytics and service improvements.
• May be used for AI training only with explicit consent.

6. DATA OWNERSHIP

• All User Content (Personal & Non-personal Data) remains the property of the User.
• BNP AI may use final project results (renders, AI-generated visuals) for portfolio and marketing unless Exclusive Image Rights are purchased.
• Confidential files (CAD drawings, contracts, business plans) will never be disclosed.

7. NDA (NON-DISCLOSURE AGREEMENT)

1. BNP AI Guarantees
   • Your intellectual property remains yours.
   • BNP AI will not share, resell, or use your project files beyond agreed purposes.
   • BNP AI will never approach your clients or partners.
   • Exceptions apply only if disclosure is legally required (e.g., court order).

8. IMAGE RIGHTS

1. Standard Image Rights (Default)
   • BNP AI may use project visuals for portfolio, website, social media, brochures, and advertising.
   • Confidential supporting documents (e.g., construction plans) remain private.
2. Exclusive Image Rights (Optional Upgrade)
   • Clients may purchase Exclusive Rights.
   • BNP AI then waives all rights to use generated visuals for marketing or portfolio.
   • Must be agreed upon in writing before delivery.

9. COOKIES & TECHNOLOGY

• BNP AI uses cookies, web beacons, and similar tools for functionality, analytics, and marketing.
• Users can disable cookies, but some site features may not work properly.
• Third-party ads/links are not covered by this policy.
